RELEASE OF LIABILITY AND WAIVER OF ALL CLAIMS

WARNING: By signing this document you and your personal representative give up the right to sue. Waivers have held in Courts. Consider that you are assuming both physical and legal risks. Please read carefully.

I THE UNDERSIGNED, HEREBY ACKNOWLEDGE the activity I am participating in under the arrangement of CanTico Kayaks & Eco-Tours, employees, agents and associate; involves risks and dangers, which are inherent to year round kayaking, eco-tours and wilderness traveling.

I UNDERSTAND that Water & Land are generally in a natural state and contains natural and inherent hazards, and other hazards associated with year round Kayaking, Fly Fishing and Eco-Activities conducted on the Water & Land, some of which include:

a. Mountain terrains, Rivers, Lakes and Ocean - The lands are mountainous areas that are uncontrolled, unmarked and not inspected. Risks, dangers and hazards in mountainous terrain include, but are not limited to, difficult condition, rivers, creeks and ocean; rocks; boulders; forest deadfall and depression on or below the surface; cliff; variable and difficult weather conditions; and wild animals.

b. Hazards and Inherent Risks Associated with Year Round Kayak Touring, fishing and Eco-Tour Activities- There are inherent risks dangers and hazards associated with kayak, fishing and Eco-Tour activities on Land and Water which include, but are not limited to traffic on roads (vehicle, quads, very steep roads and tracks, hazards created by road and hazards created by weather conditions includes washout, land slides and flooding. Other hazards include the possibility of hazards associated with forest management activities such as timber harvesting and tree falling.

I UNDERSTAND AND AGREE that I will at all times follow any and all instruction and directions given to me by CanTico Kayaks & Eco-Tours, its employees, agents and associates.

I UNDERSTAND that, CanTico Kayaks & Eco-Tours its employees, agents and associates reserve the right to terminate or disqualify me form participating in this activity if in their opinion I am intoxicated or otherwise impaired, or I am deemed to be conducting myself in an irresponsible manner during the course of the activity. I understand that if the activity is terminated or I am disqualified from the reasons, part or all of the money paid to CanTico Kayaks & Eco-Tours. will be forfeited.

I UNDERSTAND THAT the activities associated with year round kayak touring, fishing, and eco-tours may be subject and may cause injury, or drowning. In the event of an accident resulting in damage of the equipment assigned to me and in the event that the damage is deemed to be caused by my disregard of instructions given or by undue recklessness may be held financially responsible for the said damages.

I am aware of the risks, dangers and hazards associated with Kayak Touring, Fishing and year round Eco-Tours and I freely accept and fully assume all dangers and hazards and the possibility of personal injury, death, property damage or loss resulting there from.
I ACKNOWLEDGE AND AGREE THAT:
a. I have read and understood this agreement prior to voluntarily signing it.
b. That this agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representative in the event of my death.
c. To hold harmless and indemnify CanTico Kayaks and Eco-Tours. the City of Playa Del Coco, from any and all liability for property of breach of contract or personal injury to any third party resulting form my participation.
